Terms and Conditions

When you engage Tara Lemana Portraiture to take images, you agree to the following terms and conditions:

I understand that copyright in all parts of all photographic works created by Tara Lemana Portraiture (TLP) remains the property of Tara Lemana Portraiture. Under the NZIPP Standard Terms (Form 1104), I purchase a licence to use the photographic works of the photographer.

PAYMENT TERMS

Payment  is due on upon issue of invoice for services being undertaken. Photos, including digital media, will not be released until payment has been made. All overdue accounts may incur a late payment fee.

Overdue accounts will be referred to a debt collection agency for recovery and the debtor will be liable for the debt collection costs, which may include any legal costs.  The debt collection agency may provide such default information to other parties, including but not limited to credit reporting companies who may use that information for their clients. Furthermore the debt collection agency may load  a credit default with a credit reporting company.

PROMOTIONAL USE:

I understand that Tara Lemana Portraiture may use photographic works created under this agreement for promotional purposes and as submissions to professional photographic competitions.

SESSION FEES:

I understand that the session fee charged by Tara Lemana Portraiture is a retainer to reserve an agreed upon time slot in Tara Lemana’s calendar, and is to be paid within 7 days of invoice date for my session to be confirmed. Should I fail to pay my session fee upon invoice without making alternative arrangements with TLP, I understand my agreed session time will no longer be held, and may be allocated to another customer.

Should I cancel my booking with Tara Lemana within five business days of my session time, I understand that my session fee may not be refunded, as my spot in Tara Lemana Portraiture’s calendar will not be able to be filled with another booking at short notice, but may still be transferred to a new booking time.

If my booking includes a design consult with TLP, and this has taken place at the time of my cancellation, I acknowledge that my booking fee will not be refunded and will be used to offset the cost of time already spent on designing my session.

PROMOTIONAL (DISCOUNTED) SESSION FEE SESSIONS:

For discounted sessions, I understand that should I cancel my session within 48 hours of my session time, my discounted session fee spot is forfeit and to reschedule, I will be charged a standard session fee to reserve another spot on the Tara Lemana Portraiture calendar.

DATABASE:

I hereby give permission for my details to be added to Tara Lemana Portraiture’s client database for the purposes of tracking and managing all aspects relating to my photo session, including but not limited to contracts, invoicing and order processing. Tara Lemana Portraiture hereby undertakes never to sell my details to anyone, and that the only persons granted access to my details by Tara Lemana Portraiture will be those employed by Tara Lemana Portraiture in a database administration related capacity and those responsible for technical support on the database management software.
